Article I.
Basic provision
- Pursuant to Section 5 (O) of Act No. 18/2018 Coll. on the Protection of Personal Data, as amended (hereinafter referred to as the " Act ") is a muscle beast.com (hereinafter referred to as the " Controller ").

- Personal data means any information about an identified or identifiable natural person; An identifiable natural person is a natural person who can be identified, directly or indirectly, in particular by reference to a specific identifier, such as a name, an identification number, location data, a network identifier or to one or more specific elements of the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.
Article II
Sources and categories of personal data processed
- The controller processes the personal data you have provided to the controller or the personal data that the controller has obtained on the basis of the fulfilment of your order.
- The Operator processes your identification and contact data and data necessary for the performance of the contract.
Article III.
Legal Basis and Purpose of Personal Data Processing
- The legal basis for the processing of personal data is
- performance of the contract between you and the operator pursuant to Section 13 (1) (b) of the Act
- legitimate interest of the operator in the provision of direct marketing (in particular for sending commercial communications and newsletters) pursuant to Section 13 (1) (f) of the Act
- Your consent to processing for the purpose of providing direct marketing (in particular for sending commercial communications and newsletters) pursuant to Section 13 (1) (A) of the Act in the event that no goods or services have been ordered.
- The purpose of the processing of personal data is
- processing your order and exercising the rights and obligations arising from the contractual relationship between you and the operator; when ordering, personal data are required that are necessary for the successful processing of the order (name and address, contact), the security of personal data is a necessary requirement for the conclusion and performance of the contract, without the provision of personal data it is not possible to conclude a contract or perform it by the operator,
- sending commercial communications and carrying out other marketing activities.
Article IV.
Personal data retention period
- The controller stores personal data
- for the time necessary to exercise the rights and obligations arising from the contractual relationship between you and the Operator and to assert claims arising from these contractual relationships (for a period of 15 years from the termination of the contractual relationship).
- After the expiry of the personal data retention period, the controller deletes the personal data.
Article V.
Recipients of personal data (subcontractors of the controller)
- The recipients of personal data are persons
- Participation in the delivery of goods/services/execution of payments under the contract,
- provision of services for the operation of e-commerce (Shoptet) and other services in connection with the operation of e-commerce,
- Provision of marketing services.
Article VI.
Your rights
- Under the conditions set out in the law, you have
- the right to access your personal data pursuant to Section 21 of the Act,
- the right to rectification of personal data pursuant to Section 22 of the Act or restriction of processing pursuant to Section 24 of the Act,
- the right to erasure of personal data pursuant to Section 23 of the Act,
- the right to object to processing pursuant to Section 27 of the Act;
- the right to data portability pursuant to Section 26 of the Act;
- the right to withdraw consent to processing in writing or electronically to the address or e-mail address of the Controller specified in Article III of these Terms and Conditions.
- You also have the right to lodge a complaint with the Office for Personal Data Protection if you believe that your right to personal data protection has been violated.
Article VII
Personal data security conditions
- The Controller declares that it has taken all appropriate technical and organisational measures to secure personal data.
- The Controller declares that only persons who have been authorised to it have access to personal data.
Article VIII
Final provisions
- By submitting an order from the online order form, you confirm that you are familiar with the terms of privacy and that you will accept them in full.
- You agree to these terms by reviewing your agreement via the online form. By checking your consent, you confirm that you are familiar with the terms of personal data protection and that you agree to them in full.
- The Operator has the right to change these terms and conditions. It will publish a new version of the terms and conditions on its website and at the same time send you a new version of these terms and conditions to the e-mail address you have provided to the operator.
These Terms and Conditions are effective September 5, 2018.
